Mr. Anil Kumar Joshi, learned counsel for the petitioner. 2. Mr. Narayan Dutt, learned Brief Holder for the State of Uttarakhand. 3. Petitioner is a Government Servant. He was transferred from Government Inter College, Banbhoolpura, Haldwani, District Nainital to Government Higher Secondary School, Hartola, Ramgarh, District Nainital, vide order dated 30.07.2024. Feeling aggrieved by her transfer, petitioner approached this Court. No interim order was passed in favour of petitioner. 4. Learned State Counsel submits that at the time of his transfer, petitioner had served for 14 years, 6 months and 27 days at Sugam places, therefore, he was transferred, as per provisions of Transfer Act. While the services rendered by petitioner at Durgam place was a little more than one year. 5. Transfer is an incidence of service. As per Transfer Act, a Government Servant, after serving at Durgam places for a specified period becomes liable to be transferred to Durgam place. 6. Admittedly, petitioner served at Sugam places for more than 14 years, thus she is liable to be transferred to Durgam place. Law is well settled that judicial interference with transfer order 2026:UHC:365 has to be minimal. In the writ petition, no ground is taken that the order impugned is infected with malice or there is infraction of Service Rules. 7. Hence there is no scope for interference with the impugned order. Accordingly, the writ petition fails and is dismissed.
