This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- “a) Issue an appropriate writ, order or direction directing the Respondents to refund the earnest money deposited by the Petitioner. b) Issue a writ of certiorari or any other appropriate writ quashing the arbitrary conditions contained in the e-auction brochure, including the forfeiture clause, insofar as they are sought to be applied to the Petitioner; c) Issue a writ of mandamus directing the Respondents to not take any coercive steps, including forfeiture of earnest money or levy of penalties, against the Petitioner; This is a digitally signed order. Ms. Kapoor, learned counsel for respondent No. 2, on instructions states that the respondent No. 2 will refund the earnest money of Rs. 10,00,000/- within 4 weeks from today. 3. Accordingly, the respondent No. 2 shall return Rs. 10,00,000/- without any interest. 4. The same is acceptable to Mr. Verma, learned counsel for the petitioner. 5. The return of Rs. 10,00,000/- shall be made by way of demand draft in favour of the petitioner i.e., Mr. Tapay Singh within 4 weeks from today. 6.
