Mr. Ajeet Kumar Yadav, learned counsel for the petitioner. 2. Mr. Yogesh Chandra Tewari, learned Standing Counsel for the State of Uttarakhand. 3. Petitioner has challenged the order passed by Prescribed Authority/District Magistrate, Udham Singh Nagar under Section 11(2) of UP Imposition of Ceiling On Land Holdings Act, 1960. By the said order, Prescribed Authority refused to remove the land belonging to petitioner from proceedings under Ceiling Act. 4. Learned State Counsel, however, raised objection that petitioner has remedy of appeal under Section 13 of the aforesaid Act. 5. Learned counsel for the petitioner submits that petitioner has approached the Appellate Forum, however, the appeal is not being decided. 6. Having regard to the facts of the case, this Court does not find any reason to interfere in the matter. Since petitioner’s appeal is reportedly pending before Appellate Authority, therefore, the writ petition is disposed of with a direction to the Appellate Authority to consider and decide petitioner’s appeal, as per law, within six months from the date of presentation of certified copy of this order.
