The present appeal has been filed under Section 37 of the Arbitration and Conciliation Act, 1996, read with Section 13 of the Commercial Courts Act, 2015, challenging the order dated 11.05.2026 passed in O.M.P. (I) (COMM) No. 198/2026, titled M/s Shanti Developers v. Virender Kumar. 2. Learned Counsel appearing for the Appellant, after making submissions at some length and upon realising that the Court is not inclined to issue notice, seeks permission to withdraw the present appeal. He, however, submits that, while deciding the application under Section 9 of the Arbitration and Conciliation Act, 1996, the learned Single Judge has made certain observations which ought not to be treated as a final expression on the merits of the case. 3.
