The petitioner to avoid hitting the EB box, he had moved the vehicle to one side, at that time, the defacto complainant sustained an injury to his right wrist, for which, a case has been registered. Further, the petitioner to show his bonafide took the injured to the hospital and also spent money for medical expenses. Hence, according to the petitioner, no case is made out. 3.The learned Additional Public Prosecutor submits that the petitioner not only caused injury to the defacto complainant, and also dashed against the EB box and caused damage. It is further submitted that the accident occurred due to the petitioner’s rash and negligent driving. The point raised by the petitioner is factual in nature and can be decided only during trial. 4.Considering the above submissions and on perusal of the materials available on record, this court is of the view that the issues raised are factual in nature and require appreciation of evidence, which can be done only during trial.
