JUDGMENT
This Criminal Revision Case has been filed challenging the
order dated 10.10.2025 passed by the learned Family Court-cum- VI Additional District Judge, Kadapa, in Crl.M.P.No.187 of 2024 in M.C.No.82 of 2023.
2. I.A.No.1 of 2026 has been filed by the petitioner seeking to condone the delay of 28 days in filing the present revision.
3. Heard Sri Mohd Nazeeruddin Khan, learned counsel for the petitioner and Sri K.Sandeep, learned Additional Public Prosecutor for the State.
4. The petitioner herein and respondent No.1 are husband and wife. Respondent Nos.2 to 4 are their children. Respondent Nos.1 to 4 filed M.C.No.82 of 2023 seeking maintenance under Section 125 of Cr.P.C, wherein a petition was filed in Crl.M.P.No.187 of 2024 seeking interim maintenance of Rs.20,000/- per month, whereby the learned Trial Judge while allowing the said petition granted Rs.5,000/- each per month to respondent Nos.1 to 4 herein towards interim maintenance. Aggrieved by the said order, the petitioner herein filed the present Criminal revision.

5.
Learned counsel for the Petitioner would submit that the maintenance granted by the learned trial Judge is not sustainable. It is submitted that the respondent No.1 wilfully chose to remain ex-parte in restitution of conjugal rights filed by the petitioner vide O.S.No.184 of 2023. He would further submit that respondent No.1 deserted the petitioner and filed the present maintenance case only to get financial benefits from the petitioner. He would submit that Respondent No.1 is an educated lady and very much capable to earn her livelihood. The petitioner herein submits that he is ready to bear the food and educational expenses of the children independently.
6. Learned Assistant Public Prosecutor opposed the revision and would submit that Court that the order passed by the learned trial Court is well reasoned one and does not brook any interference of this Court. She finally prays to dismiss the revision.
7. Considering the submissions made and as can be seen from the record, an amount of Rs.5,000/- each to Respondent Nos.1 to 4 was granted as interim maintenance vide order dated 10.10.2025 by the learned trial Judge in M.C.No.82 of 2023. The record further shows that the petitioner is drawing salary of

CRL.R.C.NO.158 OF 2026 Rs.94,467/- per month, the interim maintenance granted by the learned trial Court totaling Rs.20,000/- per month to respondent Nos.1 to 4. In view of the same, this Court is of the opinion that the petitioner could not establish any illegality in the impugned
order. Viewed from any angle, the impugned order does not warrant any interference of this Court in Revision.
8. In such circumstances, this Court is of the view that there are no tenable grounds to interfere with the said order. This Court does not find any sufficient cause to condone the delay of 28 days in filing the revision case.
9. Accordingly, I.A.No.1 of 2026 is dismissed. Consequently, the Criminal Revision Case is also dismissed.
10. However, the learned Trial Judge is directed to dispose of the matter as expeditiously as possible, without granting any adjournment by mere asking and report the progress to the Registrar (Judicial) by 31.03.2026.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
