1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Derabish P.S. Case No.22 of 2026 corresponding to G.R. Case No.43 of 2026 pending in the file of learned J.M.F.C. (CT), Kendrapara on the grounds stated therein.
3. Perused the FIR as at Annexure-1. The offences are bailable in nature. A copy of the order in G.R. Case No.43 of 2026 dated 22nd January, 2026 is produced and it reveals that the co-accused persons therein have been released on bail with conditions. It is submitted that the petitioners are similarly situated. Learned counsel for the State informs the Court that petitioner No.2 is having one criminal antecedent to his credit. Considering the nature of allegations revealed from the FIR i.e. Annexure-1 and in spite of the fact that the offences are bailable in nature, the petitioners apprehend arrest for higher
offences, this Court, taking into account release of the accused persons by the learned court below though not inclined to grant pre-arrest bail to any of them, however, is of the view that they should be directed to surrender before the learned court below for being released with conditions.
4. Accordingly, it is ordered.
5. In the result, ABLAPL is disposed of. It is further
directed that in the event, the petitioners surrender within a fortnight from today before the learned J.M.F.C. (CT), Kendrapara in connection with Derabish P.S. Case No.22 of 2026 corresponding to G.R. Case No.43 of 2026, they shall be released on bail subject to them furnishing bail bonds of Rs.20,000/- (Rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case.
6. Issue urgent certified copy as per rules.
