JUSTICE ANUROOP SINGHI Order 10/02/2026 The present petition has been filed with the following prayer:- “It is therefore humbly prayed that Your Lordships may very graciously be pleased to accept and allow this Civil Writ Petition and by issuing an appropriate writ, order or direction in the nature [2026:RJ-JP:6224] (2 of 3) [CW-2608/2026] thereof be further pleased to direct the Sub Divisional Officer, Dholpur and the Tehsildar Dholpur to ensure the compliance of the judgment and decree dated 21.12.2021, passed by the Revenue Appellate Authority, Bharatpur, in the execution petition no.27/2022 titled as Triveni v. State of Rajasthan through District Collector, Dholpur, pending before the Ld Court of Sub-Divisional Officer, Dholpur to conclude the proceedings finally within a period of two months in the interest of justice. Any other favorable order in favour to the Petitioners which this Hon’ble Court may deem fit and proper in the interest of Justice.” Learned counsel for the petitioner submits that execution application was filed by the petitioner before the learned Revenue Appellate Authority on 31.05.2022, which has been registered as Execution Case No.27/2022 however, since then, no proceedings have been carried out therein. Learned counsel for the petitioner has relied upon the judgment of the Hon’ble Supreme Court titled as Rahul S. Shah vs. Jinendra Kumar Gandhi & Ors., (2021) 6 SCC 418, to submit that the Executing Court must dispose of execution proceedings within six months from the date of filing of the same, which may be extended only by recording reasons for such delay. While there is no quarrel to the proposition of law laid down by the Hon’ble Supreme Court, there is no occasion for the petitioner to file the present petition before this Court seeking the prayers made herein. It would certainly be open for the petitioner to file an appropriate application before the Executing Court or before the learned Board of Revenue, praying for early disposal of the matter. [2026:RJ-JP:6224] (3 of 3) [CW-2608/2026] Accordingly, the present writ petition is dismissed with liberty to the petitioner to file an appropriate application before the Executing Court. Pending application(s), if any, shall stand disposed of. (ANUROOP SINGHI),J DIKSHA MISHRA /17
