The petitioners are apprehending their arrest in connection with Complaint Case No. 104/2021, registered under section 33(1) (C) of Indian Forest Act, pending in the Court of learned Judicial Magistrate, Ist Class, Chatra. 3. Learned counsel for the petitioners submits that false allegations are made of cultivation of poppy plant in the forest area. He further submits that even the land is not belonging to the petitioners and petitioners have got no criminal antecedent which is disclosed in para 12 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and 2026:JHHC:17361 2 submits that allegations are there of cultivation of poppy plant. 5. Considering that the land is of the Forest Department and petitioners have got no criminal antecedent which is disclosed in para 12 of the petition and further one of the co-accused person has been granted anticipatory bail in ABA No.511 of 2026, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, Ist Class, Chatra, in connection with Complaint Case No. 104/2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
