JUSTICE R DEVDAS - 3 - HC-KAR NC: 2026:KHC:10603 WP No. 3015 of 2026 ORAL ORDER The grievance of the petitioner is that despite the Assistant Commissioner allowing the petitioner’s father's appeal and setting aside the grants made in favour of certain other persons on the ground that the Committee has failed to consider the application filed by the petitioner's father along with that of the other applicants and thereafter, in view of the orders passed by the Assistant Commissioner, the Deputy Commissioner directing the Tahsildar by communication dated 16.05.2022 that he shall consider the application filed by the petitioner's father along with that of others, no orders have been passed by the Tahsildar/Committee for regularization of unauthorized occupation. 2. Today the learned AGA, however, submits on instructions that such orders passed by the Assistant Commissioner were challenged by some of the original grantees including Sri Kempaiah in RP.No.14/2010-2011, where Sri Arjunappa, the father of the petitioner herein is - 4 - HC-KAR NC: 2026:KHC:10603 WP No. 3015 of 2026 respondent No.3 and the revision petition was dismissed on 17.01.2024 and therefore, the Committee has to now take up the applications for reconsideration. 3. Having regard to the admitted fact that the Deputy Commissioner dismissed the revision petition on 17.01.2024, paving the way for the Tahsildar to place the applications of the rival claimants before the Committee for reconsideration, there has been sufficient lapse on the part of the respondent-Tahsildar in placing the applications of the petitioner's father along with that of the other applicants in whose favour the grants were earlier made, but were subsequently cancelled, to enable the Committee to consider the rival applications and pass necessary orders. 4. Consequently, the writ petition stands disposed of with a specific direction to the respondent- Tahsildar, Hosakote Taluk, to place the application of the petitioner's father Sri Arjunappa along with that of the other applicants or rival applicants before the Committee - 5 - HC-KAR NC: 2026:KHC:10603 WP No. 3015 of 2026 for regularization of unauthorized occupation within a period of six weeks from the date of receipt of a copy of this order. 5. The Committee shall, thereafter, consider the applications and pass necessary orders as expeditiously as possible and at any rate within a period of two months from the date on which the application is placed by the Tahsildar before the Committee.
