The present petition has been filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), seeking quashing of FIR No. 206/2026, registered at Police Station Laxmi Nagar, District East, Delhi, for offences punishable under Sections This is a digitally signed order. 115(2), 126(2), 303(2), 351 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP for the State accepts notice on behalf of the State. 4. The petitioners, appearing through video conferencing (VC) and respondent no. 2 who is present in court, have been duly identified by their respective learned counsels and the concerned Investigating Officer (IO). 5. Learned APP for the State vehemently opposes the quashing of the FIR, submitting that the allegations are serious in nature. He further submits that the offence of extortion was subsequently added at the stage of filing of the charge-sheet. 6. Briefly stated, on 08.06.2026, owing to certain business dealings, an altercation took place between the Petitioners and Respondent No. 2 at the residence of the Petitioners at Priyadarshini Vihar, Laxmi Nagar, Delhi.
On the complaint of Respondent No. 2, FIR No. 206/2026 dated 22.06.2026 was registered at Police Station Laxmi Nagar under Sections 115(2), 126(2), 303(2), 351 and 3(5) of the BNS, alleging assault, criminal intimidation, wrongful confinement, snatching and theft. 7. Prior thereto, cross-FIR No. 200/2026 dated 18.06.2026 had been registered on the complaint of Petitioner No. 2 against Respondent No. 2 under Section 79 of BNS, arising from the same incident. The Petitioners were granted anticipatory bail by separate orders dated 30.06.2026, and investigation in both FIRs was subsequently transferred to the Crime Branch. 8. their disputes vide Settlement Agreement dated 06.08.2026. Respondent No. 2 agreed not to pursue FIR No. 206/2026, while Petitioner No. 2 agreed not to pursue FIR No. 200/2026, which forms the subject matter of connected CRL.M.C. 6318/2026. Petitioner No. 3 also agreed to withdraw his complaint dated 08.06.2026. The settlement records that the belongings of Respondent No. 2 were returned and that no monetary or property claim survives between the parties. 9. On a query made by this Court, respondent No. 2, who has been duly identified by the IO, has stated that he entered into the Settlement Agreement dated 06.08.2026 of his own free will and without any pressure, coercion, undue influence or threat. He has further stated that he has no objection if the aforementioned FIR is quashed. 10. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties.
In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed. 11. Therefore, FIR No. 206/2026, registered at Police Station Laxmi Nagar, District East, Delhi, for the offences punishable under Sections 115(2), 126(2), 303(2), 351 & 3(5) of the BNS, along with all consequential proceedings emanating therefrom, is hereby quashed. 12. The present petition is accordingly disposed of. Pending application(s), if any, also stand(s) disposed of. This is a digitally signed order.
