[2026:RJ-JP:7563] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2165/2026 Sonu Khan S/o Nasaruddin, R/o Village Hanotiya, Police Station Suket, Tehsil Ramganjmandi, District Kota (Rajasthan) (At Present Confined In Central Jail Kota, District Kota.) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Ajay Singh Yaduvanshi For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 17/02/2026 1. The present bail application has been filed by the accused- petitioner under Section 483 of B.N.S.S. in connection with F.I.R. No.112/2025 registered at Police Station Suket, District Kota Rural for the offence(s) punishable under Section(s) 115(2), 189(2), 126(2), 118(2) & 110 of B.N.S. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further contends that the matter pertains to a sudden altercation between the parties, consequently a cross F.I.R. has been lodged by the petitioner. Learned counsel also submits that no specific overt act has been assigned to the petitioner, none of the injuries sustained by the injured person is dangerous to life and the other co-accused persons, namely Safaruddin, Nasaruddin, Sharukh, Rijwan, Monu @ Juber & Tinu @ Sameer, have been enlarged on bail by Co-ordinate Benches of this Court. Learned counsel further contends that the petitioner is in custody since long, the charge-sheet has already been filed in the matter and the conclusion of trial will take considerable time, so no fruitful purpose would be served by keeping [2026:RJ-JP:7563] (2 of 2) [CRLMB-2165/2026] the petitioner in custody, and therefore, on the ground of parity, prays to enlarge the petitioner on bail. 3. Learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner hereinabove. 4. Taking into consideration the overall facts & circumstances of the case; the arguments advanced by learned counsel for the petitioner, the fact that the charge-sheet has already been filed in the matter; co- accused persons have been released on bail and trial will take considerable long time in its conclusion, thus, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Sonu Khan S/o Nasaruddin, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
