Petitioner seeks quashing of FIR No. 0188/2025, registered at Police Station Dwarka North, for commission of offences under Sections 110/115(2)/351(3) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 308/323/506 (Part-II) IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. Aforesaid FIR was registered on the basis of complaint of Mr. Sarfraj who is employed as Aviation Security Compliance Officer at IGI Airport, New Delhi. On 17.05.2025, when he was entering Radisson Mall through entrance gate along with his wife, a vehicle came from behind. The driver was repeatedly honking and when he asked him to resist from the above, he got enraged and started using abusive words. After the requisite investigation, accused i.e. petitioner herein was apprehended. 4. He is presently on bail. 5. Charges have already been ascertained. 6. The petition has been filed on account of amicable settlement between the parties. Copy of Settlement Agreement dated 11.08.2026 has also been placed on record. 7. Respondent No. 2 is present in person and he has been duly identified by investigating officer. 8. He reiterates the terms of settlement and submits that since petitioner has apologized to him, he has accepted his apology and he is, therefore, no longer interested in pursuing with the aforesaid FIR. He also submits that he has already been adequately compensated for the injuries which he had received in the aforesaid incident and, therefore, he would have no objection if FIR in question is quashed. He submits that as per terms of settlement, petitioner has also undertaken that he would not indulge in such act in future and has also undertaken not to interfere in the personal affairs of the complainant. He submits that he has entered into the abovesaid settlement out of his own free will, without any coercion, force, threat and influence from any corner whatsoever. 9. Petitioner has, reportedly, no previous bad antecedents. 10. During course of the arguments, petitioner expressed his remorse and undertook to be careful in future. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. In any case, even the complainant does not wish to press any charges against the petitioner. 12. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 13. Consequently, to secure the ends of justice, FIR No. 0188/2025, registered at Police Station Dwarka North, for commission of offences under Sections 110/115(2)/351(3) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 308/323/506 (Part-II) IPC), along with all consequential proceedings arising therefrom, is quashed subject to petitioner’s depositing a sum of Rs. 25,000/- as cost with Delhi High Court Legal Services Committee within four weeks from today. 14. Original Settlement Agreement and original affidavits of the parties, copies of which have been filed with the present petition and proof of deposit of cost, shall be submitted before the learned Trial Court within further two weeks so that these become part of Trial Court Record. 15.
