Order No.02 Dated- 16.06.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with NCB Crime No. 01/NCB/Ranchi (N.D.P.S. Case No. 4 of 2015) registered for the offences punishable under sections 8(c)/20(b) (ii) (C)/25/29 of N.D.P.S. Act.
Learned counsel for the petitioner files the supplementary affidavit. Keep the same in the record. This is the second journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was dismissed as withdrawn vide order dated 05.05.2026 in B.A. (Filing) No. 24916 of 2025. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was transporting 250 kg of ganja which comes under commercial quantity, for selling the same and while he was transporting the same, he was nabbed by the personnel of Narcotics Control Bureau. It is then submitted that so far four witnesses have been examined by the prosecution and they have supported the case of the prosecution and taken the name of the petitioner to be the driver of the tuck in which the said contraband was transported. It is further submitted that the allegations against the petitioner are all false and co-accused-owner of the truck who
has not been named in the deposition of witnesses so far examined in the trial court, has been admitted to bail. It is then submitted that the petitioner has been in custody since 21.02.2025, as has been mentioned in paragraph no. 09 of the bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned counsel for the Narcotics Control Bureau on the other hand vehemently opposes the prayer for bail of the petitioner and submits that keeping in view the serious nature of allegation against the petitioner of being involved in transportation and sell of ganja in commercial quantity, the rigors of Section 37 of N.D.P.S. Act is attracted in this case and in the absence of any material to believe that the petitioner is not guilty of the offence and that he is not likely to commit any offence while on bail as also the chance of the petitioner absconding, if released on bail, keeping in view the evidence that has already come on record; the petitioner ought not to be admitted to bail. Considering the serious nature of allegation against the petitioner and the chance of the petitioner absconding, if released on bail, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail at this stage.
Accordingly, the prayer for bail of the abovenamed petitioner is rejected. (Anil Kumar Choudhary, J.)
