Order No.02
Date: 16.06.2026
1. Heard learned counsel for the parties.
2. This Letters Patent Appeal challenges the learned Single Judge’s
order dated 28th June, 2023 disposing of W.P.(S) No.5709 of
2022. This L.P.A. was filed on 12th April, 2024 i.e., after delay of 456 days, not to mention the several defects involved in its filing.
2026:JHHC:17378-DB 2
Despite the delay, the State did not even bother to file any interlocutory application seeking condonation of delay.
3. In connected L.P.A. No.531 of 2025, we declined to condone the delay of 558 days in filing the same by our order made today i.e., 16th June, 2026.
4. Since, this appeal is hopelessly barred by limitation and there is no application seeking condonation of delay, we dismiss this appeal.
5. However, assuming that reasons similar to those set out in the I.A. seeking condonation of delay in instituting L.P.A. No.531 of 2025 following our order, we decline to condone such delay.
6. This appeal is, accordingly, dismissed. I.As., if any therein, do not survive and are disposed of.
