JUSTICE CHANDRA PRAKASH SHRIMALI Order 05/02/2026 1. This bail application has been filed by the accused-petitioners under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, who have been arrested in connection with FIR No.291/2025 registered at Police Station Civil Lines, District Ajmer for the [2026:RJ-JP:5327] (2 of 4) [CRLMB-2203/2026] offence under Sections 103(1), 109(1), 115(2), 191(2) and 3(5) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners are innocent and they have been falsely implicated in this case. It is contended that name of all the petitioners found no mention in the FIR. There is matrimonial dispute between the co-accused and complainant's wife. It is also contended that there is no dangerous to life injuries caused to complainant Ishwar Lal and other injured Kalpesh, Saajan, Tejal and Rekha. It is alleged in the FIR that the other co-accused came at 12:30 AM in a pickup vehicle bearing No.RJ-42-GA-4009 and assaulted the injured. It is also mentioned in the FIR that the other co-accused, after making hue and cry by the victim, fled away from the place of occurrence and the pickup vehicle ran over through complainant's aunts Meenakshi and Pinki, resulting into their death. It is also contended that the specific allegation of causing death by running over the pick up vehicle is against the other co-accued Vikas and all the material witnesses in their statement rendered under Section 180 of BNSS have specifically mentioned that the vehicle was driven by co-accused Vikas. There are no criminal antecedents against the accused-petitioners, the accused-petitioners are in custody since long and trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned counsel for the petitioners has submitted copy of charge-sheet, same is taken on record. 4. Learned Public Prosecutor appearing for the State has vehemently opposed the bail application and submitted the factual [2026:RJ-JP:5327] (3 of 4) [CRLMB-2203/2026] report. It is contended that the petitioners and other co-accused after forming an unlawful assembly came with weapons and assaulted the complainant and other persons and after making hue and cry by them, the petitioners and the other co-accused ran away in a pickup vehicle which run over the deceased, therefore, considering the aforesaid facts, the bail application of the accused- petitioners may be dismissed. 5. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 6. It is not desirable to express anything upon the merits of the case and looking to the fact that there are allegation of causing assault against the present petitioners, however, after considering the nature of injuries sustained to injured Ishwar Lal, Kalpesh, Saajan, Tejal and Rekha which were found to be simple blunt in nature and not dangerous to life and that the allegation of causing death of the deceased Pinki and Meenakshi are specifically attributed to the other co-accused Vikas, from whom, the pickup vehicle was recovered, and the fact that the name of all the petitioners are not mentioned in the FIR, therefore, considering the aforesaid facts, I deem it just and proper to enlarge the petitioners on bail. 7. Accordingly, this bail application is allowed and it is ordered that the accused-petitioners namely (1) Hetram S/o Sugan (2) Dasham S/o Late Rumal (3) Mister S/o Hetram and (4) Mukesh S/o Chhotelal, be released on bail provided they furnish a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court [2026:RJ-JP:5327] (4 of 4) [CRLMB-2203/2026] for their appearance before the Court concerned on all subsequent dates of hearing and as and when called upon to do so.
