PARUCHURI INDUMATHI The Court made the following: 2 THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI CIVIL MISCELLANEOUS APPEAL NO: 33 OF 2026 ORDER:-(per Hon’ble Sri Justice Ravi NathTilhari) This appeal has been filed by the appellant being aggrieved from the dismissal of his petition seeking divorce under Sections 13(1)(ia)(ib) of the Hindu Marriage Act,1955, vide judgment and decree dated 07.07.2025, passed in H.M.O.P.No.10 of 2022 on the file of the Court of the learned Civil Judge (Senior Division), Nandigama. 2. The appellant, namely Chinthapalli Hanumantha Rao and respondent, namely Kurama @ Chinthapalli Vamshi Priya, along with their respective counsels are present. 3. By order dated 12.03.2026, the parties were referred to the mediation. The report of the mediator of the Mediation Center of this Court vide ROC.No.469/APHCMC/2026 dated 15.04.2026 has been received. According to the said report, the matter has been settled in terms of the settlement recorded by the mediator in the proceedings dated 10.04.2026 signed by both the parties. 4. Learned counsels appearing for both the parties submit that the amount settled between them (as permanent alimony) has been paid to the respondent/wife vide the demand draft dated 08.04.2026. The details are mentioned in the proceedings. 3 5. It has been further submitted that the parties have decided to live separately after taking divorce by mutual consent. 6. Learned counsels for the parties submit that the parties shall file petition seeking divorce by mutual consent in the appropriate forum. 7. The Civil Miscellaneous Appeal is disposed of finally, making the settlement recorded in the proceedings dated 10.04.2026 along with the report of the mediator as part of this Judgment. 8. The parties shall file a petition for divorce by mutual consent before the appropriate forum. The learned Court shall consider liberally to waive the cooling period and shall pass orders in accordance with law expeditiously. 9. No order as to costs.
