DATED :
OCTOBER 07, 2026 P.C.:
1. There is delay of 143 days in filing the first appeal. The delay is explained by stating that there was communication gap between learned advocate representing the appellant and appellant, as a consequence of which, the appellant was not aware about passing of
judgment by learned Commissioner of Compensation. It is stated that it is only upon receiving notice in the execution that the appellant got knowledge about impugned judgment and award passed by learned Commissioner of Compensation.
2. In view of the above, statements in the application which are made on affirmation although the application is strongly opposed, the same is allowed, subject to payment of cost of Rs.2,000/- to be paid to the respondent/employee.
