After arguing for a while, when the learned counsel for the petitioner was confronted with the issue regarding the maintainability of the instant petition, wherein the petitioner has called in question the order dated 09.10.2023 passed by the learned 2nd Additional Munsiff, Jammu after a lapse of more than three years without furnishing any explanation for such delay, particularly when the learned trial Court has already proceeded with the matter and the case is now ripe for the stage of evidence, the learned counsel for the petitioner fairly submitted that he may be permitted to appear before the competent Court and, accordingly, seeks unconditional withdrawal of the instant petition. 02. Accordingly, the instant petition is dismissed as withdrawn, with liberty as prayed for, to appear before the competent Court. It is made clear that this Court has not expressed any opinion on the merits of the case, and the learned trial Court shall proceed with the matter strictly in accordance with law, uninfluenced by any observations made by this Court while dismissing the instant petition as withdrawn.
