This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 14/2019 registered at Police Station Gharghoda, District – Raigarh (C.G.), for the offence punishable under Section 21(C) of Narcotic Drugs and Psychotropic Substances Act. 2. The earlier bail application of the applicant being MCRC No. 1046 of 2019 was allowed by a co-ordinate Bench of this Court vide order dated 01.03.2019. 3. As per the prosecution story, on 19.01.2019, on the basis of information received from an informant, police personnel searched the applicant and seized 20 bottles of cough syrup, each containing 100 ml, from his ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.02.03 13:23:20 +0530 2 possession. On the basis of the said seizure, an offence was registered against the applicant and he was arrested on 19.01.2019. 4. Learned counsel for the applicant submits that the applicant had previously filed M.Cr.C. No. 1046/2019, which was allowed on 01.03.2019, and he was granted bail. During the course of the trial, the applicant remained absent as he was unaware of the dates of hearing. She submits that, consequently, his bail bonds were cancelled on 09.05.2023, and the applicant was thereafter produced before the learned trial Court on 23.09.2025. She further submits that the present applicant has no criminal antecedents and has been in custody since 23.09.2025. The conclusion of the trial is likely to take considerable time. On these grounds, a prayer is made for grant of regular bail to the applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the case pertains to the year 2019. The applicant was granted bail by a co-ordinate Bench of this Court on 01.03.2019; thereafter, he absconded, and his bail bonds were cancelled on 09.05.2023. He failed to appear before the concerned trial Court, as a result of which the trial could not proceed. It is further submitted that, if the applicant is enlarged on bail, there is a likelihood that he may abscond again and hamper the trial. Hence, the bail application is liable to be dismissed. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Upon perusal of the pleadings and the material placed before this Court, it transpires that the case pertains to the year 2019. The applicant was granted bail by a co-ordinate Bench of this Court on 01.03.2019, thereafter, he absconded, and his bail bonds were cancelled on 3 09.05.2023. He failed to appear before the concerned trial Court, as a result of which the trial could not proceed. In these circumstances, there is every likelihood that, if released on bail, he may abscond again and further hamper the trial. Therefore, I am not inclined to grant regular bail to the present applicant. 8. Accordingly, the second bail application of the applicant – Sudhir Gupta, filed under Section 483 of the BNSS involved in Crime No. 14/2019 registered at Police Station Gharghoda, District – Raigarh (C.G.), for the offence punishable under Section 21(C) of Narcotic Drugs and Psychotropic Substances Act, is rejected. 9.
