Dey ….for the State Mr. Sayan Kanjilal ….for the Respondent No. 5 The grievance of the petitioner is directed against the refusal of the WBSEDCL to provide an electricity connection to the petitioner. It is submitted on behalf of the petitioner that there are private civil disputes by and between the petitioner and the private respondent and the electric connection to the premises of the petitioner has been arbitrarily and illegally disconnected. In view of the submission made on behalf of the petitioner, WPA 5627 of 2026 stands disposed of by granting liberty to the petitioner to file a fresh application for electricity connection with the WBSEDCL. If such application is received the same 2 shall be processed and disposed of within 72 hours from the date of receipt thereof and after compliance with all statutory formalities and payment of prescribed fees, if the preconditions for permitting such electricity connection are fulfilled. The WBSEDCL is directed to install a separate electricity connection to the premises of the petitioner within seven days from allowing such application. The grant of the above electricity connection will not create any equity in favour of the petitioner insofar as the pending civil disputes are concerned. Liberty is granted to the WBSEDCL to take police assistance, if the circumstances so warrant. The Report filed by the Officer-in-Charge of the concerned Police Station be kept with the record. It appears prima facie from the said Report that the same has been instigated by the private respondents. The costs for the police assistance should be borne by the petitioner.
