By way of the present petition filed under Section 582 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), the petitioners seeks quashing of FIR No. 1199/2022 registered for the offences punishable under Sections 377/498A/323/506/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) registered at Police Station Mahendra Park and all consequential proceedings arising therefrom, in view of the amicable settlement arrived at between the parties. 3. Issue notice. Learned APP for the State accepts notice. 4. The Petitioners and Respondent No. 2 are present before this Court and have been duly identified by the Investigating Officer (IO) concerned. This is a digitally signed order. Brief facts of the case are that the marriage between Petitioner No. 2 and Respondent No. 2 was solemnized in Delhi in the year 2018. Respondent No. 2 alleged physical and mental cruelty by the petitioners, pursuant to which FIR No. 1199/2022 under Sections 377/498A/323/506/34 of the IPC was registered at P.S. Mahendra Park. During the pendency of the proceedings, the parties amicably settled all their disputes out of court and executed a settlement/compromise deed dated 07.07.2026. In view of the settlement, the petitioners have approached this Court seeking quashing of the aforesaid FIR and all consequential proceedings arising therefrom. 6. On a query made by this Court, Respondent No. 2 categorically states that she has entered into the settlement out of her own free will and without any force, coercion or undue influence. She further states that she has been residing with the petitioners for a considerable period and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed. 7. In view of the fact that the parties have amicably resolved their matrimonial disputes, resumed cohabitation and have been living together, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 8. Accordingly, FIR No. 1199/2022, registered at Police Station Mahendra Park for the offences punishable under Sections 377/498A/323/506/34 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
