Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon'ble Court may kindly be pleased to set-aside/quash the impugned order dated 30.06.2025 (ANNEXURE-P/1), PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 4 respect to the petitioner, whereby the petitioner has been transferred from Outline Dispensary Loharsi, Block Pamgarh, District Janjgir-Champa, (C.G.) to Veterinary Hospital Bijapur, District Bijapur, (C.G.), and further be pleased to set aside the order dated 15.12.2025 (ANNEXURE-P/2) issued by the Committee, in the interest of the justice. 10.2 That, this Hon'ble Court may kindly be pleased to set-aside/quash the order dated 11.11.2025 (ANNEXURE-P/3), issued by the respondent no. 4 where by the petitioner has been relieved for transferred place, in the interest of the justice. 10.3 That, any other relief which the Hon'ble Court may deemed fit and proper also be granted to the petitioner, in the interest of justice. 2. Learned counsel for petitioner submits that petitioner is working on the post of Assistant Veterinary Field Officer and was posted at Outline Dispensary Veterinary Hospital, Loharsi, Block Pamgarh, District Janjgir-Champa. Vide order dated 30.06.2025, he was transferred to Veterinary Hospital, Bijapur, District Bijapur, C.G. The order of transfer was put to challenge by petitioner by way of filing writ petition bearing WPS No. 745 of 2025, which was disposed of vide order dated 18.07.2025 permitting petitioner to submit representation before the committee constituted under the transfer policy within a period of two weeks and further there was direction to not to take any coercive action against petitioner. Pursuant to the order passed by the High Court, petitioner submitted representation within time and continued at the present place of posting at Loharsi. Petitioner thereafter was relieved by the authorities ie., Dy. Director, Veterinary Health Service vide order dated 11.11.2025 without taking decision on the representation submitted by petitioner and therefore petitioner filed contempt petition bearing CONT. No. 1806 of 2025 and only thereafter representation submitted by petitioner was decided on 15.12.2025. He contended that the committee without considering the grounds raised by petitioner in appropriate manner has 3 / 4 rejected representation, it appears to be only because the petitioner has filed contempt petition. He next contended that three children of petitioner are studying in school and two are in advance classes ie., class 10th and class 8th, exams are to be held ordinarily in the month of February and March and are likely to be completed in last week of March. He however submits that in view of study of children of petitioner in class 10th and class 8th, the impugned order of transfer be interdicted. He also pointed out that no other employee is posted at the place of posting of petitioner but an employee is given additional charge who is a contractual employee (outsourced). 3. Learned State counsel opposes the submission of learned counsel for petitioner and would submit that earlier petitioner has filed a representation taking medical ground which the committee has found to be not a good ground to interdict the order of transfer. The ground of eduction of children which is taken by petitioner pursuant to their further studies the place of transfer of petitioner is also a district headquarter. Transfer of petitioner is on administrative exigency and therefore petitioner is having no case for interference of transfer order. 4. I have heard learned counsel for the parties. 5. The order of transfer of petitioner is dated 30.06.2025. Petitioner is transferred on administrative grounds. When question is posed to learned counsel for petitioner as to the period of posting of petitioner at the earlier place, he fairly submitted that petitioner is posted for more than 10 years at the earlier place of posting. 6. Except the ground raised by counsel for petitioner with regard to studies of children of petitioner, no other grounds have been raised to challenge the order of transfer. 7. Considering the fact that petitioner is holding post of Assistant Veterinary Field Officer and he has already completed about 10 years at the present 4 / 4 place of posting, I do not find any good ground to interfere with the order of transfer of petitioner. 8. Accordingly, this writ petition, so far as it relates to challenging the order of transfer dated 30.06.2025, Annexure P-1, is dismissed. 9. However, considering the fact that two children of the petitioner are studying in school in class 10th and in class 8th which are board examination in the State of Chhattisgarh and further considering the decision of Hon’ble Supreme Court in case of SK. Nausad Rahaman and others vs. Union of India and others reported in (2022) 12 SCC 1 and Director of School Education, Madras and others vs. O. Karuppa Thevan and another reported in (1994) Supp (2) SCC 666, petitioner was not relieved till 11.11.2025, I find it appropriate to restrain shifting of petitioner from his earlier place of posting for the limited period of time and accordingly, respondents are directed to let the petitioner continue his work at his earlier place of posting ie. at Outline Dispensary Veterinary Hospital, Loharsi, Block Pamgarh, District Janjgir-Champa till 31.03.2026, if not already joined at transferred place.
