The instant writ petition has been filed inter alia praying for a direction upon the municipality to forthwith disburse the retiral benefits as payable to the petitioner on his retirement. 2. The petitioner was an employee of Baidyabati Municipality and upon attaining the age of superannuation, the petitioner retired from service on 30th June, 2024. 3. From the copy of the Pension Payment Order (PPO) as made over before this Court by the learned advocate for the petitioner it would transpire that the PPO was issued on 22nd September, 2025. The petitioner complains that although the PPO has been issued during the pendency of the writ petition, however, the retiral benefits in terms of the aforesaid PPO inter alia, including 2 WPA 7639 of 2025 gratuity are yet to be disbursed. He is only receiving the current pension. 4. The municipality is represented. According to the learned advocate for the municipality since, the petitioner was not previously cooperating, the PPO could not be issued, subsequently the PPO has been issued. The municipality is disbursing current pensionary benefits. Insofar as the arrear pension and gratuity are concerned, the same shall be disbursed in due course. 5. Having heard the learned advocates appearing for the respective parties and noting that PPO has already been issued, I am of the view that no fruitful purpose will be served in keeping the writ petition pending, the same is accordingly disposed of with a direction upon the municipality to forthwith release the gratuity and the arrear pension in favour of the petitioner within a period of twelve weeks from the date of communication of this order. 6. With the above observations and directions, the writ petition is disposed of. Urgent photostat certified copy of this order, if applied for be given to the parties upon compliance with the requisite formalities. (Raja Basu Chowdhury, J.)
