Petitioner has filed this petition seeking following relief : “1. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions and the respondent No.1 may kindly be directed to decide the representation made by the petitioner for upgrading the ACR of 2019-2020 & 2020-21 (Annex.P/7) within a stipulated period i.e. before meeting of the departmental promotion committee. 2. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions and the departmental promotion committee may kindly be directed not to rely upon the adverse entries (Very Good) of 2019- 2020 & 2020-21 at the time of consideration of the case of the petitioner for promotion. 3. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions and the authorities may kindly be directed not to proceed further in the matter of promotion of Assistant Director Industries till the representation made by the petitioner for upgrading his ACR's (Annex. P/7) would have been decided. 4. That, this Hon'ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.” 2. Learned counsel for the petitioner submits that by efflux of time, relief as sought for in para 10.2 and 10.3 of writ petition has become infructuous as DPC has already been convened and order of promotion is issued. He however, submits that with regard to relief of up-gradation of ACR of the year 2019- 2020 and 2020-2021, 3 / 3 representation is pending consideration with respondent No.1 and therefore a direction be issued to respondent No.1 to take decision on the representation at the earliest within specified time. He further submits that he may be permitted to submit fresh representation before respondent No.2 also. 3. Learned counsel for respective respondents submit that in view of limited prayer made by learned counsel for petitioner for taking decision on pending representation, they are having no objection. 4. On due consideration of submission of learned counsel for parties nature of grievance raised, this writ petition is disposed of directing respondents No.1 & 2 to take decision on representation of petitioner in accordance with law, expeditiously, preferably within a further period of 3 months from the date of receipt of copy of this order.
