MADHAVA RAO NALLURI Counsel for the Respondent/complainant(S): 1. V V LAKSHMI NARAYANA 2. PUBLIC PROSECUTOR The Court made the following 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NOS: 1461 and 1848 of 2025 COMMON ORDER : These Criminal Petitions have been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.2 to 4 in Crl.P.No.1461 of 2025 and petitioner/accused No.1 in Crl.P.No.1848 of 2025 for granting of pre-arrest bail in connection with Crime No.39 of 2025 on the file of Chilakaluripeta Town Police Station, Guntur District, registered for the alleged offences punishable under Sections 343, 506 r/w 34 of IPC and Sections 3(1)(r), 3(1)(s), 3(2) (va) of SC & ST (POA), Act. 2. Since the subject matter of these Criminal Petitions is one and the same, at the request of the learned counsel on both sides, these matters are heard together and the following common order has been passed. 3. Heard the learned counsel for the petitioners and the learned Public Prosecutor representing on behalf of the State. Perused the record. 4. The case of the prosecution, in brief, is that the de facto complainant is an active member of the Telugu Desam Party and was appointed as the in- charge of the party’s social media for the Chilakaluripeta Constituency. The petitioners/accused Nos.1 to 4 unlawfully detained the de facto complainant, and on 21.08.2019, they abused him by using his caste name and subjected him to custodial torture. Further, the petitioner/accused No.1 also abused the 4 de facto complainant during a WhatsApp video call by uttering his caste name. Based on the complaint lodged by the de facto complainant, the present crime was registered. 5. Learned counsels for the petitioners would submit that a false case has been lodged against the petitioners, wherein the Coordinate Bench of this Court has granted anticipatory bail to the petitioners. The learned counsels for the petitioners would further submit that initially the Coordinate Bench of this Court has granted interim protection to the petitioners/accused Nos.2 to 4 in Crl.P.No.1461 of 2025 vide order dated 18.02.2025 and also granted interim protection to the petitioner/accused No.1 in Crl.P.No.1848 of 2025 vide order dated 01.04.2025. Learned counsels for the petitioners would further submit that petitioners have been in the protection since from the beginning. Their liberty may be continued subject to imposing any conditions by this Court. 6. Learned Public Prosecutor would submit that the petitioners are not entitled for anticipatory bail and investigation is still pending. He finally prays for dismissal of the petition. 7. Considering the submissions made and a fair look at the material placed on record before this Court, several contentions raised in the present petitions are disputed factual aspects of the matter which requires investigation at full length of trial. In that scenario, since there is no dispute about the fact that in the present case the petitioners are at liberty from the beginning, nothing is brought to the notice of this Court that the petitioners have misused the liberty which is granted to them. In that view of the matter, 5 while continuing the interim protection granted by the Coordinate Bench of this Court in Crl.P.No.1461 of 2025, dated 18.02.2025 to the petitioners/accused Nos.2 to 4 and in Crl.P.No.1848 of 2025, dated 01.04.2025 to the petitioner/accused No.1, these Criminal Petitions are disposed of with the following conditions: i.
