JUSTICE R DEVDAS ORAL ORDER The grievance of the petitioner is that his father filed application in Form No.53 seeking regularization of unauthorised occupation of land in Sy.No.31 of Honnenahalli Village, Sompura Hobli, Nelamangala Taluk and Bengaluru Rural District to an extent of 1 acre 23 guntas has not been considered till date. The petitioner's father had submitted multiple representations to consider his application submitted in Form No.53. Therefore, the prayer in the petition is to direct the respondents to consider the representations at Annexures- E1 to E3 and till consideration, direct the respondents not to interfere with the peaceful possession and enjoyment of the petition schedule properties. 2. Having regard to the contentions raised in the writ petition and submission of the learned counsel for the petitioner, this Court is of the considered opinion that - 4 - HC-KAR NC: 2026:KHC:11477 WP No. 37416 of 2025 respondent No.3-Tahsildar was duty bound to place the application filed by the petitioner before the ‘Committee for Regularization of Unauthorized Occupation’ and the Committee was also duty bound to consider the application and pass necessary orders. 3. The writ petition stands disposed of with a specific direction to respondent No.3-Tahsildar, Nelamangala Taluk, to verify from the records as to whether such application filed by the petitioner's father at Annexure-A dated 28.12.1998 is pending consideration. If it is found that such application was indeed filed by the petitioner's father and the application is yet to be considered, the Tahsildar is directed to place before the Committee for regularisation of unauthorised occupation, the applications along with his recommendation within a period of two months from the date of receipt of a copy of this order. Thereafter, the Committee shall consider the application and pass necessary orders in accordance with law as expeditiously - 5 - HC-KAR NC: 2026:KHC:11477 WP No. 37416 of 2025 as possible and at any rate within a period of two months from the date of receipt of a copy of this order.
