JUSTICE R DEVDAS ORAL ORDER The grievance of the petitioner is that respondent No.2 - Tahsildar, Sargur Taluk has not acted upon the representation dated 23.06.2025 at Annexure-B and legal notice dated 20.09.2025 got issued by the petitioner, to mutate and enter the name of the petitioner in the RTC pursuant to the registered sale deed dated 01.07.2010. It is contented that the petitioner purchased the lands in question namely 3 acres including 4 guntas of karab in Sy.No.389 of Sagare Village, Kandalike Hobli, H.D.Kote Taluk, from Sri.Kencha Naika S/o Sanna Naika, who was the Kathedar at the relevant point of time. 2. Learned High Court Government Pleader however raises an objection that the sale deed is of the year 2010 and the representation is given in the month of June 2025 and a legal notice is got issued in the month of September 2025. 3. Normally this Court would dispose of such petition while imposing costs on the respondent - State and the Tahsildar having regard to the provisions contained in the - 4 - HC-KAR NC: 2026:KHC:11471 WP No. 4748 of 2026 Karnataka Sakaala Services Act, 2011, where a time of 60 days is stipulated for change of khata pursuant to registered instruments. However as rightly pointed out by the learned HCGP, though the sale deed is registered in the year 2010, the representation or application for change of khata is given only in the month of June 2025 and legal notice is got issued in the month of September 2025. 4. Therefore, the writ petition stands disposed of with a specific direction to respondent No.2 - Tahsildar, Sargur Taluk to consider the representations given by the petitioner, issue notice to the legal heirs of the petitioner's vendor and proceed in accordance with law to enter the name of petitioner, pursuant to the registered sale deed, as expeditiously as possible and at any rate within a period of 2 months from the date of receipt of a copy of this order.
