It is stated that this transfer of petition is filed by the petitioner-wife for the transfer of divorce petition filed by respondent-husband in MC No.105/2025 pending on the file of the Additional Senior Civil Judge and JMFC, Nelamangala. Petitioner - wife requested for transfer of the said case to Belur Taluk, Hassan District. She is residing there along with her parents and also has a child aged 3 years.

3. It is stated that she also filed Crl.Mis.P.No.781/2025 on 15.10.2025, in which maintenance was also granted; the learned counsel for the petitioner stated that still the respondent - husband has not paid any amount.

Learned counsel for the respondent - husband stated that the respondent is working as a ' group employee on contract basis in Vidhana Soudha and getting salary of Rs.12,000/- per month. He is residing in Nelamangala. The distance between both the places is 189 km. The learned counsel for the respondent stated that it is difficult for the respondent to appear on each and every day by taking leave, as he is working on a contract basis and he is also trying for pay maintenance.
5. It is stated that three criminal complaints are filed while they are living together at Nelamangala. It was also brought to the notice of this Court that initially she was residing in a separate house at Nelamangala, but the respondent - husband failed to pay the rent, and as such,

HC-KAR NC: 2026:KHC:11453 CP No. 452 of 2025 she vacated the same and joined her parents at Belur Taluk, Hassan District.

In the application it mentioned to transfer the petition to Principal Family Court, Hassan, but the learned counsel for the petitioner stated that petition should be transferred to Family Court at Belur. Considering the above facts, this Court finds it reasonable to transfer MC No.105/2025 filed by the respondent - husband for divorce from Additional Senior Civil Judge in Nelamangala to Family Court at Belur as it is inconvenient for the petitioner to travel all the way with minor child aged 3 years. Accordingly, I pass the following order:
ORDER The petition is allowed.
2. MC.No.105/2025 filed by the respondent- husband on the file of Additional Senor Civil Judge and JMFC, Nelamangala is transferred to the Family Court at Belur.

3. However, the respondent - husband is at liberty to file the chief affidavit before the Family Court and he can be cross examined either through a commissioner or through video conferencing and his attendance before the Court need not be insisted upon except as and when it is necessary for the Court.
