02/16.06.2026 Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Pirtand P.S. Case No. 04 of 2026, registered for the offence under Sections 191(1), 126(1), 115(1), 118(1), 109(1), 76, 303(2), 351 and 352 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Giridih.

Learned counsel appearing for the petitioners submits that the altercation took place due to the land dispute and the first case has been lodged by the petitioners’ side thereafter, the present case has been filed against the petitioners as a counter blast case. He further submits that some of the accused persons have been granted anticipatory bail by the impugned order itself. He next submits that both sides have received injury and sister-in-law of the petitioners has received grievous injury and that was subject matter of the FIR lodged by the petitioners’ side.

Learned counsel appearing for the State opposes the prayer and submits that the allegations of assault are there and pursuant to that the injury has been received.

Looking to the contents of the FIR, it transpires that the allegations of assault are there against the petitioners, however, it has been pointed out that both the sides have received injury and first case has been lodged by the petitioners’ side and thereafter, the present case has been lodged and some of the co-accused persons have been granted anticipatory bail by the learned Sessions Judge and altercation took place due to land
2026:JHHC:17309 dispute, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Giridih, in connection with Pirtand P.S. Case No. 04 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
