Also heard Shri Priyank Rathi, appearing for the respondent/State. 1. Petitioner has filed the present petition for the following relief(s):- “10.1 That, this Hon’ble Court may kindly be pleased to allow the instant petition and kindly grant temporary parole/bail from 17.02.2026 to 21.02.2026 to the petitioner for the purpose of making arrangements during the Digitally signed by V PADMAVATHI Date: 2026.02.03 13:13:19 +0530 Wpcr 68 of 2026 2 marriage ceremony and also his presence to perform the custom and ritual at the time of marriage of his son Shiwank fixed on 19.02.2026 to 20.02.2026. 10.2 Any other relief or relief(s) which this Hon’ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.” 2. Petitioner was charged for the offences under Section 302 (four times), 307 of the IPC, and Section 25(1B)(a) and 27(1) of the Arms Act alleging that on 09.12.2017, petitioner has committed murder of four Police persons by firing. 3. Learned counsel for the petitioner would submit that learned Additional Sessions Judge, Special Court (Naxal) Dantewada, District- South Bastar, Dantewada in Session Trial-104 of 2018 has convicted the petitioner vide its judgment dated 27.08.2024. Petitioner preferred an appeal vide Criminal Appeal-1950 of 2024, which was decided by this Hon’ble Court on 19.06.2025, by which learned trial Court’s judgment has been upheld. Thereafter, petitioner has preferred Special Leave Petition (Criminal) Diary No.60260 of 2025 (231 of 2026) which was decided on 06.01.2026 and dismissed the SLP with liberty to the petitioner to apply his parole before the jurisdictional High Court, hence this petition. It is further submitted that marriage of petitioner’s son Shiwank is fixed on 19.02.2026, and the petitioner being father, his presence at the Wpcr 68 of 2026 3 time of marriage is necessary to perform some customary rituals of the marriage. More over, his presence is a must in the house at the time of marriage of his son, as there is no elder member in the family except petitioner, and his wife. Petitioner shall abide all the terms and conditions imposed upon him by this court. 4. On the other hand, learned Government Advocate appearing on behalf of the State opposes petitioner’s parole. 5. We have heard learned counsel for the parties and perused the documents annexed with the petition. 6. Considering the fact that marriage of petitioner’s son Shiwank is going to be married on 19th and 20th February, 2026, petitioner may approach before the District Magistrate, Bijapur for grant of parole for the purpose of marriage function of his son, along with copy of this order. In such eventuality, the said authority shall decide the application so filed by the petitioner, after verification of the relevant facts and documents and pass appropriate order in accordance with law.
