The instant bail application has been filed by the petitioner - Sagar Sonkar S/o Late Shri Sanjay Sonkar @ Sanju, aged about 33 Years, arrested in connection with FIR No.24/2026, Police Station Civil Lines, District Ajmer, for the offences under Sections 8/20 of NDPS Act. 2. Learned counsel submits that the alleged contraband substance recovered is quantified at 10 kg 155 g, which is below the commercial quantity of 20 kg. He further submits that the petitioner has previous involvement in two cases of similar nature, in which he is on bail as noted in the trial Court’s order while rejecting his bail. In the present case, the only allegation was in respect of less than commercial quantity. As far as the other cases are concerned, they have already been decided and no such other case is pending. Therefore, he prayed that the accused petitioner may be enlarged on bail. [2026:RJ-JP:10754] (2 of 2) [CRLMB-3169/2026] 3. Learned Public Prosecutor has opposed the bail application. 4. Considering the overall facts and circumstances of the present case, the fact that the alleged contraband is less than commercial quantity and noting that the petitioner is on bail in criminal cases in terms of the orders of co-ordinate Bench of this Court dated 04.02.2026 and 08.07.2025 and without commenting upon the merits or demerits of the case, this Court deems it just and proper to grant bail to the accused-petitioner. 5. Accordingly, the bail application filed under Section 483 BNSS is allowed and it is directed that accused-petitioner Sagar Sonkar S/o Late Shri Sanjay Sonkar @ Sanju shall be released on bail in connection with 24/2026, Police Station Civil Lines, District Ajmer, provided he executes a personal bond in a sum of Rs.1,00,000/- along with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse the liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. 6. In case the petitioner is found to be involved in any criminal case within a period of three years from the date of passing of this order, the learned Public Prosecutor shall file an application for cancellation of his bail.
