Learned senior counsel appearing for the appellant fairly submits that the writ petition, in the form it was filed, may not be maintainable on the strength of Power of Attorney executed by M/S Aadhitya Constructions in favour of Mushtaq Ahmad Dar for the Special Power of Attorney does not contain a specific authorization, authorizing Mushtaq Ahmad Dar to file legal proceedings in the Court of law for and on behalf of M/S Aadhitya Constructions. 2. Learned senior counsel, however, submits that, in these circumstances, he may be permitted to withdraw the writ petition with liberty to file fresh one either by M/S Aadhitya Constructions or through its duly authorized attorney.
