Case No. 29/2026, registered under Sections 61(2)/318(4)/317(2)/317(4)/336(3)/340(2)/3(5) of BNS, 2023. Page No.# 2/3 The gist of the case is that on 05.09.2026, an FIR was lodged before the Officer In- charge of Simen Chapori PS, alleging that a group of persons headed by Md. Samsul Ali had allegedly been operating and coordinating an organized cattle trading/transportation syndicate for a considerable period of time. In terms of the FIR, police registered Simen Chapori P.S. Case No. 29/2026, under the aforementioned Sections. The learned counsel for the accused-applicant submits that the main accused, namely, Md. Samsul Ali has already been granted bail. However, the present accused- applicant has received notice under Section 35(3) BNSS from the investigating officer, therefore, he is apprehending arrest in the instant case. Therefore, he prays for pre-arrest bail of the accused-applicant. Case Diary received has been perused. The learned Addl. PP, on the other hand, fairly submitted that protection can be granted to the present accused-applicant with a specified time for his appearance. Taking into consideration the aforesaid submissions, this Court is of the considered opinion that the accused-applicant should be granted pre-arrest bail at this stage. Accordingly, it is directed that in the event of arrest of the accused-applicant, he shall be released on pre-arrest bail on furnishing a bail bond of Rs. 20,000/- with one surety of like amount to the satisfaction of the arresting authority, subject to the following conditions: - (1) That the accused-applicant shall appear before the Investigating officer as and when called for and fully co-operate in the investigation of the case. (2) The accused-applicant shall neither hamper the investigation nor tamper with any evidence nor influence any witnesses connected with the case. In view of the aforesaid directions, the instant anticipatory bail application is disposed of as allowed. Page No.# 3/3 JUDGE Miriam Degu (SPA)
