1. The petitioner – Central Bureau of Investigation [“CBI”] has filed this petition seeking transfer of the entire judicial record arising out of FIR No. 00010/2026 [60000194/2026], dated 10.01.2026, registered at Police Station Special Cell, Delhi, under Sections 308/318(4)/319/340 of the Bharatiya Nyaya Sanhita, 2023, which is presently before the Court of the Chief Judicial Magistrate [“CJM”], Patiala House Courts, New Delhi District, to the Court of Additional Chief Judicial Magistrate [“ACJM”], Rouse Avenue Courts, Central District. 2. Mr. Vikrant Pachnanda, learned Special Public Prosecutor for the CBI, submits that the case involves a digital arrest scam of approximately Rs. 14.85 crores. By virtue of an order of the Supreme Court dated 01.12.2025 read with order dated 09.02.2026 in Suo Moto Writ Petition This is a digitally signed order. TR.P.(CRL.) 68/2026 (Criminal) No. 3/2025, it has been directed that digital arrest cases involving over Rs. 10 crores are to be investigated by the CBI. 3. Mr. Pachnanda submits that, pursuant to the aforesaid orders, the Ministry of Home Affairs has issued a communication dated 10.04.2026, recording its no objection to transfer of the present proceedings to the CBI. However, he submits that the chargesheet has already been filed by the Delhi Police before the transferor Court, and the CBI intends to file a supplementary chargesheet before the transferee Court. 4. In order to ensure that the record of the case is available to the Court, which is now in seisen of the proceedings, Mr. Pachnanda seeks directions for transfer of the record of the subject FIR from the Court of the CJM, Patiala House Courts, New Delhi District, to the Court of the ACJM, Rouse Avenue Courts, Central District. 5.
In view of the aforesaid orders of the Supreme Court, it is directed that the record pertaining to FIR No. 00010/2026 [60000194/2026], dated 10.01.2026, registered at Police Station Special Cell, Delhi, be transferred from the Court of the CJM, Patiala House Courts, New Delhi District, to the Court of the ACJM, Rouse Avenue Courts, Central District, where supplementary chargesheets will be filed by the CBI in RC2332026E0005/2026, dated 29.04.2026, registered at Police Station Cyber Crime Branch-EO-IV. 6.
