That, this Hon’ble Court may kindly be pleased to call for the entire record pertaining to the present case. 10.2 That this Hon'ble Court may please to quash the impugned Expression of Interest" dated 26.12.2025 (ANNEXURE P-1) issued by the Respondent No. 04 in respect of Atal Bazar and Kundrapara under the Ward No.05. 10.3 The Hon'ble High Court may kindly be pleased to decide the request dated 08.01.2026 (ANNEXURE P-2), submitted by the Petitioner, arising out of "Expression of Interest" dated 26.12.2025 2 issued by Respondent No. 04, without cancelling the work order dated 09.10.2025 issued for 05 years, by the Respondent authority, in the interest of justice. the 10.4 The Hon'ble High Court may kindly be pleased to direct the Respondent authorities not to proceed further with the "Expression of Interest" Dated 26.12.2025, & Petitioner be allowed to discharge their duties in compliance of the work order dated 09.10.2025, till the final adjudication of the present petition. 10.5 The Hon'ble High Court may kindly be pleased to grant any other relief(C), as it may deemed fit and proper under the facts and circumstances of the case in favour of the Petitioner, in the interest of justice.” 2 Learned counsel for the petitioner submits that the respondents department executed an agreement with the petitioner on 07.10.2020 for up-keeping the toilets situated at Atal Bazar and Kundrapara Ward No.5, Tifra, Bilaspur under Swakshata Shreengar Yojna and accordingly work order was issued in favour of petitioner on 12.10.2020 for five years under certain terms and conditions. The petitioner completed his tenure of five years and finding their work satisfactory, the work order was extended for another five years vide order dated 09.10.2025. When the petitioner went to the office of respondents on 01.12.2025 with a request letter to carry out certain repairing work in the toilet, then only a notice was served to him on the same day i.e. on 01.12.2025 alleging violation of certain conditions mentioned in the agreement executed between the parties, to which the petitioner replied on 03.12.2025. However, without considering the reply submitted by the petitioner, the respondent department issued fresh Expression of Interest on 26.12.2025 for fresh contract of said work without terminating the agreement executed in favour of petitioner. The petitioner raised his objection on 08.01.2026 seeking cancellation of Expression of Interest dated 26.12.2025, however, the same has not been decided till date. Hence this petition. 3 3 Leaned counsel for the respondents/department would submit that the petitioner was not complying with the directions/guidelines mentioned in the agreement and was unable to maintain cleanness of the Toilets for which the petitioner was engaged and therefore a notice was issued to him on 24.11.2025 seeking explanation for the same after getting the toilets physically verified by a team constituted by the Municipal Corporation. A reminder was issued on 01.12.2025 seeking reply on the explanation to which also the petitioner did not respond and ultimately vide order dated 11.12.2025 the agreement dated 09.10.2020 was cancelled stating that he has failed to comply with certain guidelines mentioned in the agreement and only therefore fresh Expression of Interest has been issued on 26.12.2025. Thus, the action of the part of respondents cannot be said to be arbitrary in any manner. 4 Having heard the counsel for the parties and having perused the material annexed with the writ petition, once the petitioner’s agreement has already been terminated on 11.12.2025 and intimation of which was already forwarded to the petitioner, though receiving such intimation/cancellation has been denied by the petitioner, but as the petitioner’s contract/agreement has already been terminated vide order dated 11.12.2025, we are not inclined to entertain the writ petition. 5 Accordingly, the writ petition is dismissed reserving the right of the petitioner to take recourse under the provisions of law against cancellation/termination of contract vide order dated 11.12.2025.
