This writ petition (civil) has been preferred by petitioner under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus quashing RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.01.30 10:43:50 +0530 2 the unilateral changes to the loan terms (interest rate increase, EMI hike to Rs. 18,292/-, and tenure extension to 30 years) by Respondents Nos. 1 & 2, as reflected in the statement dated 23.07.2025. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing Respondents Nos. 1 & 2 to restore the original loan terms (20-year tenure, 11.65% interest rate, EMI Rs. 16,921/-) with immediate effect, adjust any excess payments towards principal, and provide a revised repayment schedule. 10.3 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing Respondent No. 3 to expeditiously decide the petitioner's complaint dated 29.10.2025 within a time-bound period e.g. 15 days, in accordance with Reserve Bank Integrated Ombudsman Scheme, 2021. 10.4 That, this Hon'ble Court may kindly be pleased to direct the Respondents Nos. 1 & 2 to pay compensation of Rs. 5,00,000/- (or as deemed fit) to the petitioner for financial loss, mental distress, and litigation costs caused by their arbitrary actions. 10.5 That, any appropriate writ, direction or order may also kindly be passed in favour of the petitioner, which this Hon'ble Court deems fit in the circumstances of the case.” 3. Learned counsel for the petitioner submits that the petitioner availed a home loan of Rs.14,00,000/- from respondent No.2 / Bandhan Bank, Branch Pandri on 31.12.2015. The tenure of the loan was 20 years, the rate of interest was 11.65% per annum and the EMI was Rs.16,921/-. He further submits that without consent of the petitioner and without issuing any prior notice, respondents No.1 and 2 have changed the terms of loan pertaining to the tenure, rate of interest and EMI. He also 3 submits that the petitioner has filed a complaint dated 29.10.2025 (Annexure -P/6) before the respondent No.3 / Banking Ombudsman, but even after lapse of more than two months, the said complaint has not been decided by respondent No.3 till date. Hence, at this stage, learned counsel prays that this petition may be disposed of with a direction to respondent No.3 / Banking Ombudsman to decide the aforesaid complaint (Annexure-P/6) filed by petitioner, within a stipulated period as specified by this Court. 4. Though the petitioner has sought various reliefs in instant petition but at this stage, she seeks direction of the Court to the respondent No.3 only to decide her complaint dated 29.10.2025 (Annexure -P/6). 5. Having considered the limited prayer made by learned counsel for the petitioner, at this stage, this petition is disposed of directing respondent No.3-Banking Ombudsman, Reserve Bank of India to decide the complaint dated 29.10.2025 (Annexure -P/6) filed by petitioner, as per provisions of the Reserve Bank-Integrated Ombudsman Scheme, 2021 expeditiously, preferably within a period of 30 days from the date of receipt/submission of a copy of this order. 6. With aforesaid observation and direction, this writ petition stands disposed of. 7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
