1. Petitioner has filed this writ petition seeking following reliefs:- 10.1 That, this Hon’ble Court may kindly be pleased to quash order dated 25.06.2025 issued by the District Education Officer cum Secretary, District Rationalization Committee, District Raipur, C.G. (Annexure P/1). 10.2 That, this Hon’ble Court may kindly be pleased to quash order dated 05.06.2025 issued by the District Education Officer cum Secretary, District Rationalization Committee, District Raipur, C.G. (Annexure P/2). 10.3 That this Hon’ble Court may kindly be pleased to direct the respondent State to make new counseling list adding the name of the private respondents and thereafter reconduct counseling from junior to senior so that the petitioner can avail benefit of seniority. 10.4 The Hon’ble Court may kindly grant any other writ/writs, order/orders, relief/reliefs in favour of the petitioner, which the Hon’ble court deemed fit and just in the facts and circumstances of the case, including awarding of the costs to the petitioner.”

Learned counsel for petitioner submits that petitioner who is holding the post of Assistant Teacher (LB) at Govt. Primary School, Benedih, block- Aarang, District Raipur is transferred/posted at Govt. Primary School, Semariya (Parsada), Block Aarang, District Raipur under the Rationalization scheme. Petitioner aggrieved by which have earlier challenged the order under rationalization before the District Level Committee headed by District Education Officer and the representation
3 / 3 was rejected against which this writ petition is filed. She also submits that during pendency of this writ petition the petitioner has also submitted representation/appeal before the Divisional Level Committee headed by Divisional Commissioner which also came to be dismissed, therefore, petitioner has filed an application seeking amendment to challenge this order also.

Learned counsel for State submits that under rationalization policy State Government has formulated three different committees i.e. District Level Committee, Divisional Level Committee and State Level Committee. As from documents enclosed along with this writ petition it is reflecting that petitioner has availed two remedies i.e. District Level Committee and Divisional Level Committee and further remedy is available to petitioner to file proceedings before State Level Committee and therefore, petitioner is having an alternate remedy.
4. At this stage, learned counsel for petitioner submits that in view of objection being raised by learned counsel for the State she may be permitted to withdraw this writ petition with liberty to file proceedings/representation/appeal before the State Level Committee headed by DPI.

In view of submission made by learned counsel for petitioner, this writ petition stands dismissed as withdrawn with liberty to file representation/appeal before State Level Committee headed by DPI as formulated under the Rationalization Policy. If the petitioner submits representation/appeal before the State Level Committee concerned authority shall take decision on representation/appeal in accordance with law, preferably within further period of two months from the date of receipt of representation/appeal considering the grounds raised in an objective manner.
