1. 1. This matter is taken up through Hybrid Mode. 2. Heard learned counsel appearing for the parties. 3. Petitioner has filed the present writ petition inter alia with the following prayer:-
Under such circumstances, it is humbly prayed that this Hon’ble Court may kindly be pleased to admit the case and issue notice to the Opp. Parties as to why the case of the Petitioner shall not be allowed and after hearing the parties, the case of the Petitioner be allowed and direction be given to the Opp. Parties NO.1 for release of pension and pensionary benefit in favour of the Petitioner by fixing the pay of the Petitioner's Late husband as per ORSP rules 2008 and regularizing thd period of suspension i.e. 01.08.2005 to 21.05.2007 by treating it is qualifying service and the arrear to that effect be paid within a period of 1 month.
And/or give direction to the Opp. Party No. 1 for disposal of the representation of the petitioner vide Annexure-7 dt 12.8.2025 relating to revision of scale of pay as per ORSP Rules, 2008 and regularization of the suspension period within a period of 2 months and the petitioner be paid all the financial benefit within a stipulated period. And/or pass such other order/orders, as this Hon'ble Court may deem fit and proper for the ends of justice. And for this act of kindness the petitioner shall duty bound ever pray.. 5. In course of hearing, learned counsel for the Petitioner states that highlighting her grievance, Petitioner has made a representation before Opposite Party No.1 vide Annexure-7 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection. 6. As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, dispose of the Writ Petition directing Opposite Party No.1 to consider and dispose of the representation filed by the Ppetitioner vide Annexure-7 within a period of three (3) months from the date of receipt of this order with due communication to the Petitioner. 7. The Writ Petition stands disposed of with the aforesaid observation and direction.
