JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for respondent Nos.1 to 5. Notice to respondent No.6 is not necessary for the following reasons: 2. Learned Additional Government Advocate has raised a preliminary objection that the order impugned is passed by the Deputy Director of Land Records under Section 49(A) of the Karnataka Land Revenue Act, 1964 (for short 'the Act') and any person aggrieved of such an order is required to file a second appeal under Section 50 of the Act. 3. Learned counsel for the petitioner however seeks to contend that though the petitioner is shown as respondent No.4 in the proceedings before the Deputy Director, nevertheless a wrong address is shown and the petitioner was not served with a notice and the Deputy Director has set aside the phodi proceedings that has - 4 - HC-KAR NC: 2026:KHC:14970 WP No. 7671 of 2026 happened in the year 2017 without condoning the delay. Therefore, the learned counsel submits that the objection raised by the learned Additional Government Advocate should not be sustained and this Court is not barred from entertaining the writ petition even on the ground of availability of alternative remedy. 4. In the considered opinion of this Court, since the petitioner is arrayed as respondent No.4 in the proceedings before the Deputy Director, the petitioner cannot contend that the order impugned has been passed without notice to the petitioner. The appellate authority is competent to consider such contentions that would be raised by the petitioner by calling for the records. 5. Accordingly, the petition stands disposed of reserving liberty to the petitioner to approach the appellate authority.
