Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 07.02.2026 passed by the learned Additional Sessions Judge-I, Bermo at Tenughat in B.P. No. 10 of 2026 arising out of Dugdha (Jharia O.P.) P.S. Case No. 79/2021 (G.R. No. 1573 of 2021), whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that some miscreants exploded bombs in Ghutwa mines, BCCL and had caused panic amongst the workers. A message was also received on the mobile of the informant giving a threat to the informant.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confession of the co- accused. It has been submitted that the appellant is in custody since
08.12.2025.
Learned Spl.PP has opposed the prayer for bail of the appellant and has submitted that the appellant has several criminal antecedents.
Regard being had to the manner of implication of the appellant, we while setting aside the order dated 07.02.2026 passed by the learned Additional Sessions Judge-I, Bermo at Tenughat in B.P. No. 10 of 2026 arising out of Dugdha (Jharia O.P.) P.S. Case No. 79/2021, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees
Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bermo at Tenughat in connection with Dugdha (Jharia O.P.) P.S. Case No. 79/2021 (G.R. No. 1573 of 2021).
This appeal is allowed.
