Also heard Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 for granting the privilege of pre-arrest bail to the petitioner, namely, Abdul Basit @ Basit Ali, in connection with PRC No. 1743/2025 pending in the Court of the learned Chief Judicial Magistrate, Sribhumi arising out of Ratabari P.S. Case No. 54/2025. The petitioner has been shown as an absconder in the chargesheet, which alleges commission of a Page No.# 2/2 session’s triable offence. It is submitted that the petitioner is interested in facing the trial. But he apprehends that he will be remanded to custody if he appears before the court of the learned Chief Judicial Magistrate, Sribhumi. I have considered the submissions made by the learned counsel for both sides. Since the petitioner is interested to appear before the court and face the trial, he deserves to be given an opportunity. In view of the above, the petitioner Abdul Basit @ Basit Ali is directed to appear before the court of the learned Chief Judicial Magistrate, Sribhumi in connection with PRC No. 1743/2025 within next 15 (fifteen) days from today. On his appearance, the learned Chief Judicial Magistrate, Sribhumi shall release the petitioner on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Sribhumi. The petitioner is directed to appear before the learned trial court on each and every date of hearing and if he fails, the learned trial Court shall have the liberty to procure his attendance by following due process of law. The bail application is disposed of. JUDGE Comparing Assistant
