The State of West Bengal Mr. Priyankar Ganguly Ms. Shalini Bairagi Ms. Pipasa Chakraborty …for the Petitioner The petitioner herein is aggrieved with the order dated 19th January, 2026 by which the court below had issued warrant of arrest against the present petitioner in connection with the G.R. case no. 1795 of 2024, presently pending before the learned Additional Chief Judicial Magistrate, Jangipur, Murshidabad. Being aggrieved by the aforesaid proceeding, learned counsel for the petitioner submits that the petitioner was all along present before the court below and only on 5th January, 2026 and 19th January, 2026, he could not appear before the court below due to his personal difficulties but the court below had issued warrant of arrest against the present petitioner without asking the surety to produce the accused person before the court below. Now the petitioner wants to surrender before the court below and he may be given liberty. Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made by the petitioner, the opposite party will have no cause to prejudice, the service of 2 copy of the application upon the opposite party are dispensed with. In view of the aforesaid submission made on behalf of petitioner, CRR 813 of 2026 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of two weeks from this date and in the event of such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observations made herein. The impugned order dated 19th January, 2026, which pertains to the issuance of warrant of arrest against the petitioner, is hereby stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier.
