This application has been preferred by the appellant for condoning a delay of 42 days in filing the appeal.
Having been satisfied with the reasons assigned in this application, the delay of 42 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

This appeal is directed against the order dated 21.01.2026 passed by the learned Principal District & Sessions Judge, Jamtara in MCA No. 33 of 2026 in connection with S.T. No. 32 of 2026 arising out of Fatehpur P.S. Case No. 48/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on a secret information that some persons were involved in immoral trafficking, a raid was conducted at Raj Hotel, Kairabani and the appellant and his wife who were fleeing were apprehended. Both the apprehended accused had disclosed that they were involved in the business of flesh trade. Several incriminating articles were recovered from their possession.
Submission has been advanced by the learned counsel for the appellants that he is in custody since 20.12.2025. It has further been submitted that the wife of the appellant, namely, Sangita Kumari has been
granted bail by a Coordinate Bench of this Court in Criminal Appeal (DB) No. 524 of 2026. Learned counsel adds that the appellant does not have any criminal antecedent.
Learned Spl.PP has opposed the prayer for bail of the appellant.
Regard being had to the period of custody undergone by the appellant, we while setting aside the order dated 21.01.2026 passed by the learned Principal District & Sessions Judge, Jamtara in MCA No. 33 of 2026 in connection with S.T. No. 32 of 2026 arising out of Fatehpur P.S. Case No. 48/2025, direct that the appellants be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Principal District & Sessions Judge, Jamtara in connection with in connection with S.T. No. 32 of 2026 arising out of Fatehpur P.S. Case No. 48/2025.
This appeal is allowed.
