Today this case is listed for consideration of application I.A. No. 02/2025 for condonation of delay in payment of process fee. 2. Notice was issued to Respondents No. 3 & 4, who are Chief Executive Officer, Jila Panchayat and Chief Executive Officer, Janpad Panchayat on 18.09.2025. As process fee could not paid in time, notices could not be issued. However, Respondent No. 4 is represented by the counsel who has PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 4 filed vakalatnama also. It is also not in dispute that the deceased employee was employed by Respondent No. 4. According to the submission made by learned counsel for Respondent No. 4, application is to be accepted by Respondent No. 4, however, application for grant of compassionate appointment is to be considered by Respondent No. 3 and to pass order recommending name of applicant either to be appointed taking decision on the application whether the appointment is to be granted or application is to be rejected. Learned counsel for Respondent No. 4 submits that till date Janpad Panchayat has not received such a recommendation letter from the office of Respondent No. 3. 3. In the aforementioned facts of the case, I find it appropriate to hear the case finally with the consent of the parties. As the counsel for the respondents No. 1, 2 & 4 are present before this court, and this Court is not considering claim of petitioner on merit at this stage, but consideration of this Court is only with regard to issuance of direction to Respondent No. 3 to take decision on the application submitted by petitioner for grant of compassionate appointment in accordance with law, it is heard in absence of Respondent No. 3. 4. Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus or direction, directing the respondent authorities to grant compassionate appointment to the petitioner, being wife and legal heir of the deceased government employee Late Sanku Ram Boga. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus or direction, directing the respondent authorities to forthwith process and disburse the family pension to the petitioner as the nominee and legal heir of the deceased government employee Late Sanku Ram Boga. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to disburse other terminal dues including gratuity, provident fund, and arrears, to which the 3 / 4 petitioner is entitled as the nominee of the deceased employee. 10.4 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to pay interest at an appropriate rate on the delayed payment of family pension and other dues, from the date of the deceased employee's death i.e. 26.04.2025 until the date of actual disbursement, to compensate for the financial hardship caused to the petitioner. 10.5 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.” 5. Learned counsel for petitioner submits that husband of petitioner late Sanku Ram Boga was working as Panchayat Secretary at village panchayat, Nedgaon who died in harness on 26.04.2025. Petitioner being legally wedded wife has submitted an application for grant of compassionate appointment on 18.08.2025 in the form of representation, which is pending consideration, no decision has been taken till date and therefore direction be issued to Respondent No. 3 to take decision on the pending representation at the earliest. 6. Ms. Akanksha Verma, learned counsel for Respondent No. 4 does not dispute the submission of learned counsel for petitioner with respect to engagement of late Sanku Ram Boga as Panchayat Secretary and posted at village panchayat Nedgaon and his service to be under Janpad Panchayat, Block Manpur, District Mohla-Manpur-Ambagarh Chowki. She however submits that two claims are received for grant of compassionate appointment against the death of late Sanku Ram Boga. He contended that one application in prescribed formate was submitted by one Anusuiya Boga claiming herself to be his first wife and the petitioner herein submitted a representation, which is not an application in prescribed formate. She submits that both the claims have been forwarded to the competent authority ie., Respondent No. 3, however, till date decision is still pending. 7. I have heard learned counsel for the parties. 4 / 4 8. Considering the facts and circumstances of the case, claim of petitioner along with another applicant is still pending consideration for orders before Respondent No. 3, competent authority, who has to take decision on the claim of the applicants for grant of compassionate appointment, instead of keeping this writ petition pending, seeking reply from Respondent No. 3, it would be in the interest of justice if the writ petition is disposed of directing Respondent No. 3 to consider claim of petitioner along with other pending claim against death of late Sanku Ram Boga, in accordance with law within specified time frame. 9. Accordingly, this writ petition is disposed of directing Respondent No. 3 to take decision on the claim of petitioner along with one another Smt. Anusuiya Boga for grant of compassionate appointment, in accordance with law, within a further period of three months from the date of receipt of copy of order passed by this Court.
