By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No.325/2018 dated 04.07.2018 registered at PS: Khajuri Khas under Sections 363/366/368/376/120B/34 of the Indian Penal Code, 1860 (IPC), Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) and Section 11 of the Prohibition of Child Marriage Act, 2006 (PCM Act) and all proceedings emanating therefrom, since the petitioner no.1 and the respondent no.2 have settled and dissolved all their This is a digitally signed order. Issue notice. 3. Learned APP accepts notice and submits that he has no objection to the quashing of the aforesaid FIR. 4. Respondent nos.2 and 3, present in Court, also accept notice and submit that since respondent no.2 and the petitioner no.1 have amicably resolved all their disputes and are now living together in matrimonial harmony alongwith their minor child, they have no objection to the quashing of the aforesaid FIR. 5. This Court has further had the occasion of interacting with the petitioners as well as the respondent nos.2 and 3, who all are present in Court, and submit that they have agreed to put a quietus to their disputes. Respondent nos.2 and 3 submit that they do not wish to continue with the aforesaid FIR against the petitioners. 6. The petitioners and the respondent nos.2 and 3, present in Court, as well as their credentials as on record, have been identified by the IO. 7. Facts disclose that the petitioner no.1 and respondent no.2 have expressed their clear intention as also taken steps towards living their matrimonial life, as they are now residing together alongwith their minor child in peace and harmony, which stance is forming part of the accompanying affidavit(s). As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr.; (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr.; (2014) 6 SCC 466, since there is nothing left to corroborate and This is a digitally signed order.
