Mr. Srinjay Sengupta Mr. Saurav Roy Mr. Ankush Ghosh Mr. Prasenjit Jana …..for the petitioners Mr. Niladri Bhattacharjee Ms. Poulami Chattopadhyay ….for the WBTCL 1) Affidavit of service filed on behalf of the petitioner is taken on record. 2) Petitioner was an employee of West Bengal Transport Corporation Limited, who retired on superannuation on 31st October, 2024. 3) It is submitted on behalf of the petitioner that petitioner was under contributory provident fund scheme and after retirement provident fund was released in favour of the petitioner belatedly as a result whereof petitioner prays for issuance of direction upon the concerned respondent authorities to release interest on provident fund dues. 4) West Bengal Transport Corporation Limited is represented by learned advocate. 2 5) Since it is found that West Bengal Transport Corporation Limited caused delay in releasing provident fund, said authority is directed to pay interest at the rate of 6 per cent per annum on provident fund dues from the date following the date of retirement till the date of payment within a period of three months from the date of communication of this order. 6) In the event concerned respondent authority fails to pay interest on provident fund dues in terms of the aforesaid directions within the stipulated time, respondent authority shall be required to pay 8 per cent interest per annum on deferred payment. 7) If necessary, State respondents shall release requisite fund. 8) With the aforesaid directions, writ petition stands disposed of. 9) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
