2 Dr. YLR, J W.P.No.4098 of 2026 Dated 12.03.2026
The Court made the following:
ORDER:
The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents more particularly respondent Nos.2 to 4 in opening the impugned Suspect Sheet No. 91 in the year 2014 and continuing the same from past 12 years against the petitioner on the file of Gudur Rural police station as highly illegal, arbitrary, unconstitutional and consequently quash the same in the interest of justice by directing the respondents not to interfere with the petitioners life and liberty in any manner and pass….”
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Sri S. Phani Teja, learned counsel for the petitioner, submits that respondent No. 4 has falsely implicated the petitioner in Crime No. 86 of 2014 under Section 394 of the I.P.C. Consequent thereto, Suspect Sheet No. 91 was opened in the year 2014 and has been continued for the past 12 years. It is contended that, under the guise of the said suspect sheet, the petitioner has been subjected to harassment, despite his acquittal in C.C. No. 355 of 2014 by the learned Additional Judicial Magistrate of First Class, Gudur, for the said charge. 4.
Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the petitioner was involved in Crime No. 86 of 2014 under Section 394 of the I.P.C., and therefore, Suspect Sheet No. 91
3 Dr. YLR, J W.P.No.4098 of 2026 Dated 12.03.2026
was opened and is being continued after obtaining permission from the Sub-Divisional Police Officer, Gudur, in order to curb and prevent unlawful activities of the petitioner. Hence, it is urged that the Writ Petition be dismissed. 5. Police Manual Order No. 600(1) does not cover the alleged offence attributed to the petitioner. The petitioner was charge-sheeted for the offence under Section 394 of the I.P.C. on the allegation that he robbed Rs. 8,000/- from the de facto complainant in Crime No. 86 of 2014. After completion of investigation, a charge sheet was filed, and upon trial, the learned Magistrate acquitted the petitioner. The acquittal was not on technical grounds but on merits, as the prosecution witnesses turned hostile. 6. Be that as it may, Police Manual Order No. 600(1) does not justify either the opening or continuation of the suspect sheet against the petitioner. The petitioner was acquitted in the year 2018, and since then, there are no allegations or subsequent offences attributed to him warranting continuation of the suspect sheet or opening of any similar sheet. Therefore, continuation of the suspect sheet is unjustified and amounts to harassment. 4 Dr. YLR, J W.P.No.4098 of 2026 Dated 12.03.2026
7. In view of the facts and circumstances, the Writ Petition is allowed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y. LAKSHMANA RAO, J Date: 12.03.2026 PBS
