The present petition has been filed alleging wilful disobedience of the settlement arrived at between the parties vide Settlement Agreement dated 31st January, 2019, as incorporated in the judgment dated 15th February, 2019 passed by this Court in CS(OS) 3324/2014. 2. Learned counsel appearing for the petitioners submits that the dispute qua property which has fallen in favour of the respondents in terms of paragraph H of the Settlement Agreement, viz., Plot No. 195, Sector 47, Huda Haryana, situated at Gurugram, Haryana, already stands settled, and Digitally Signed By:HARIOM SHARMA Signing Date:27.08.2026 19:49:52 Signature Not Verified that a Sale Deed dated 06th August, 2026 has been executed by the petitioners in favour of the respondents. 3. Learned counsel appearing for the respondents confirms the said fact. 4. Learned counsel appearing for the petitioners draws the attention of this Court to the said Settlement Agreement to submit that the property as mentioned in paragraph A of the said Settlement Agreement has fallen to the share of the petitioners. Paragraph A is reproduced as under: “xxx xxx xxx xxx xxx xxx” 5. Learned counsel appearing for the petitioners submits that property admeasuring 1900 sq. yards has now fallen in possession of the petitioners, out the total property admeasuring 5993.3 yards situated in Sangam Vihar, Delhi. 6. Learned counsel appearing for the respondents confirms the said fact that the possession of the said portion in aforesaid property is with the petitioners. She further submits that the respondents are not interfering in the peaceful possession of the property of the petitioners, and shall not do so in future. 7. At this stage, learned counsel appearing for the petitioners has drawn the attention of this Court to the photographs attached with the present petition to submit that the boundary wall earlier sought to be constructed by the petitioners in the portion in the aforesaid property in Sangam Vihar, Digitally Signed By:HARIOM SHARMA Signing Date:27.08.2026 19:49:52 Signature Not Verified Delhi, which is already in possession of the petitioners, was not allowed by the respondents, and disturbance was created therein. She further submits that the boundary wall was broken by the respondents. 8. In response, learned counsel appearing for the respondents submits that the respondents have no objection if the boundary wall is constructed by the petitioners in the portion already under their possession in the Sangam Vihar property. 9. Accordingly, it is directed that the respondents shall not create any hindrance in the construction of the boundary wall around the portion which is in possession of the petitioners in the said property. 10. This Court also takes note of the submission made by learned counsel appearing for the petitioners that the aforesaid property in Sangam Vihar was earlier an agricultural land and is now urbanized. She, thus, submits that mutation or transfer of the said property is not open at the moment. She submits that as and when mutation of the aforesaid property is allowed by the statutory authorities, the respondents ought to cooperate in transferring the mutation of the said portion in the property situated in Sangam Vihar in favour of the petitioners herein. 11. Learned counsel appearing for the respondents assures this Court that as and when such need arises, the respondents shall duly cooperate with the petitioners in getting the said portion in the property situated in Sangam Vihar mutated in favour of the petitioners. 12. The respondents are held bound by the aforesaid undertaking, and it is directed that they shall duly cooperate with the petitioners in getting the mutation of the said portion in the property in question in favour of the petitioners.
