CORAM:
THE HON’BLE MISS JUSTICE SAVITRI RATHO
Order No.
ORDER 07.05.2026
03.
(Through hybrid mode)
1. The CRLMP has been filed with a prayer to declare the FIR dated 11.03.2026 registered before the Rengali Dam Site Police Station as a Zero FIR and to grant liberty to lodge a fresh FIR before Barkote Police Station having original territorial jurisdiction.
2. On 21.04.2026, the learned Additional Standing Counsel had been directed to obtain instructions. On 30.04.2026, the matter was adjourned on the prayer of the learned Additional Standing Counsel to today. p. 2
3. Today when the matter is taken up, he produces instructions dated 05.05.2026 of the IIC, Rengali Dam Site Police Station where it is stated as follows:
“Apropos to the letter and subject cited above, I have the honour to submit that on 11.03.2026 neither the petitioner Sushil Kumar Behera (70) S/o. Lt. Rabi Behera of vill. Jharabahal, PS. Barkote, Dist. Deogarh and his associates 1. Lingaraj Sahu 2. Ratnakar Sahu 3. Lingaraj Nayak and 4. Natabara Mohanty had attended/appeared at this PS nor lodged any FIR about the issues enumerated in the petition.
I have meticulously verified the available PS registers, records and CCTV device for 11.03.2026 but found no such entries. Arrival of the petitioner Sushil Kumar Behera along with his associates has not morphed in the CCTV device of this PS on 11.03.2026. So no FIR had been registered at this PS in this regard.”
4. Although the words “not morphed” in the second paragraph of the instructions do not make sense, but as it has been stated that the FIR has not been received in the Rengali Dam Site Police Station, it is not necessary to issue any direction to treat the said FIR as Zero FIR.
5. With the above observation, the CRLMP is disposed of.
